View Full Version : Restricted CZ858 purchase problem

CGNer vince514 bought a CZ858 last month (May 22 2018), but the CFO hasn't approved the transfer yet.
He's concerned the transfer will be approved after the June 30 2018 12.x cutoff date,
so it'll be prohibited without grandfathering, and he'll have to sell it or otherwise dispose of it (destruction).

With documentation proving he purchased/owned the gun before said date should make him eligible for grandfathering. The new regs state ownership date not registration/transfer date but, the liberal way is a mystery to me so don't quote me :)

He's paid for it, and is trying to register it, but he's concerned he won't possess it on time.

In my limited knowledge of the finer points of the English language ownership is possession. You don't have to physically be in possession of an item to possess it. I own my daughter's car for insurance reasons, it's my possession, I possess it but it's not currently in my possession... Okay, this legal stuff is making me dizzy :)

Since this is not "law" as of yet, then would this date not need to be amended to a later date before it actually becomes law?

No.

The SECU Committee hearings mentioned this repeatedly.

The Conservatives suggested an amendment to make it the royal assent date, and the Liberals rejected that change.

The restricted versions have to be registered as per the 1995 Firearms Act, nothing to do with Bill C71. As we all know, you can't possess a restricted until the CFO approves the transfer.

The non-restricted versions can't be registered as prohibited until after the bill's Royal Assent, and don't have to be registered until 1 year after royal assent.

In both cases they must be possessed before June 30 2018 (Saturday) for the PAL to be granted grandfather ability for as many of the same kind of gun they ever get.

It is a confusing situation for sure . Quite a few people have contacted the Canadian Firearms Center trying to register their non restricted CZ858s ; but are being told that they can't because C-71 has not passed into law yet .

If this date stays “hard-coded” in C-71...this is the date by which you must have possession of your soon-to-be-prohibited rifle.

What are these "soon-to-be-prohibited rifle" you speak of? Does anyone actually have any? :) I was under the impression they only exist in Canmore, Alberta!
